Terms and Conditions

Arteify Limited (company number 16348574, registered in England and Wales) operates the online marketplace at arteify.com (the “Platform”). By accessing or using the Platform, you agree to these Terms.

1. About the Platform

Arteify is a marketplace connecting buyers and sellers of art, antiques, and related works. Arteify acts as a disclosed agent for the seller: it does not own, hold, or take title to any item, and the contract of sale is formed directly between the buyer and the seller. Where the seller is a Business Seller (section 3), the seller is the “trader” responsible under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, and Arteify facilitates — and does not obstruct — buyers’ statutory rights. Arteify’s role is limited to hosting listings, running the bidding and checkout process, collecting payment and remitting it to the seller net of fees, and providing the separately published Arteify Guarantee. Nothing in these Terms excludes any liability that cannot lawfully be excluded, or any statutory right of a consumer.

2. Eligibility

You must be at least 18 years old and legally capable of entering contracts to use this Platform. By registering, you confirm these requirements are met.

3. Seller types: business and private sellers

Each seller is either a Business Seller — selling in the course of a business, trade, craft or profession (including artists selling their own work commercially, dealers, galleries and service providers) — or a Private Seller — an individual disposing of their own personal property otherwise than in the course of a business. A seller’s type is shown on each listing and determines the buyer’s rights (section 8): Business Seller sales carry full Consumer Rights Act 2015 protection and, for online sales, the 14-day cancellation right, while Private Seller sales require only that the item is as described and that the seller has the right to sell it. Each seller warrants that its stated type is accurate and must not list as a Private Seller if it is in fact trading. Arteify may reclassify a seller whose activity indicates a business (for example, sustained sales volume or sourcing goods to resell). A seller that misclassifies its status indemnifies Arteify against any resulting claim, refund or cost, which Arteify may set off against sums owed to that seller.

4. Listings and Descriptions

Sellers are responsible for the accuracy of all listing information, including title, provenance, dimensions, condition, and media. Arteify reserves the right to edit, suspend, or remove any listing that breaches these Terms or is misleading.

5. Auctions

Arteify currently runs online auctions, conducted wholly online with no option to attend in person. A contract of sale is formed on the fall of the hammer or at the scheduled close, when the highest eligible bid at or above any reserve is accepted, and the winning buyer is then bound to purchase. Because an online auction is not a “public auction” in law (which requires the option to attend in person), a consumer who wins a lot from a Business Seller has the same 14-day cancellation right as on a fixed-price purchase (see the Returns & Cancellation policy). This does not apply to lots sold by Private Sellers, to business-to-business sales, or to any auction a buyer is able to attend in person, where sales are final on the fall of the hammer. If a bound buyer fails to pay, Arteify may cancel the sale, re-offer the lot to the under-bidder, re-list it, and recover its reasonable costs. Any other auction format will be separately labelled with its own terms.

6. Buyer and Seller Fees

Current fee schedules are published on the Platform and may be updated with 14 days’ notice. Applicable fees are confirmed at the point of transaction.

7. Payments

All payments are processed through the Platform’s secure checkout. Funds are held until the seller confirms dispatch and the buyer’s statutory inspection period has elapsed or the buyer confirms receipt, whichever is earlier.

8. Returns, Cancellation and Disputes

Every item must be as described and the seller’s to sell; a buyer may return an item that is materially not as described, damaged, counterfeit, or that the seller had no right to sell, for a full refund. In addition, consumers buying from Business Sellers have a 14-day right to cancel most online purchases from the day after delivery, and full rights if an item is faulty, under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Full details, exceptions and how to claim are set out in the Returns & Cancellation policy, which forms part of these Terms. For high-value or fragile works, please do not return anything until Arteify confirms the method. Refunds are processed within 14 days of the returned item being received, or of proof of return.

9. Intellectual Property

All content on the Platform—including text, images, and design—is owned by Arteify Limited or its licensors. You may not copy or reproduce any part without written permission.

10. Liability

To the maximum extent permitted by law, Arteify’s liability to any user is limited to the fees paid by that user in the preceding 12 months. Arteify is not liable for indirect, consequential, or loss-of-profit damages. Nothing in this section limits liability that cannot lawfully be limited, or a consumer’s statutory rights against a seller.

11. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts.
